TINJAUAN YURIDIS JAMINAN HAK SOSIAL BUDAYA TERHADAP PERLINDUNGAN ATLET E-SPORTS BERDASARKAN UNDANGUNDANG NOMOR 3 TAHUN 2005 TENTANG SISTEM KEOLAHRAGAAN NASIONAL
Abstract
Indonesian sports are currently regulated in Law Number 3 of 2005 concerning the National Sports System, the existence of sports is growing, one of
which is a new type of sport, namely E-Sports. E-Sports is included in the category of achievement sports. While currently the types of sports are diverse and each
sport has its own regulations, so far the sport sector is only regulated by laws and
regulations under laws that are partial or have not regulated all aspects of national sports as a whole, and does not reflect the orderly legal order in the field of
sports. Social and Cultural Rights, which states that the State recognizes the right
of everyone to take part in cultural life, enjoy the results of scientific progress and
its applications, and benefit from the protection of the moral and material interests of scientific products. A far satisfying sporting achievement. It could be that
the cause is the welfare and rights of athletes in Indonesia which are not fully
guaranteed.
This legal research is normative legal research, normative legal research is
legal research carried out by examining library materials or secondary data consisting of primary legal materials, secondary legal materials and tertiary legal
materials. identification of problems through the statute approach is carried out
by reviewing the laws and regulations related to the legal issues under study. In
this study the authors conducted research on the principle of legal certainty. This
study examines the juridical review of socio-cultural rights guarantees for the
protection of E-Sports athletes based on Law Number 3 of 2005 concerning the
National Sports System.
The results of this study are expected to have clear rules for the protections
that will be given to E-sports athletes, justice and legal benefits for the recognition of E-Sports as a sport in Indonesia. And also what rights athletes will receive
should be included in the law and the state responsibility for the E-Sports athletes
should be realized.
