PELAKSANAAN KERJASAMA PEMASANGAN INSTALASI GARDU ANTARA PT. PRADANA MULIA RAHARJA DENGAN PT. JEONGSUK TEACH ABADI DITINJAU DARI KUHPERDATA JO UNDANG- UNDANG NOMOR 2 TAHUN 2017 TENTANG JASA KONSTRUKSI

Abstract

Agreements made legally validas the law of the parties who made it.
Construction industry has its own arrangement compiled in Law No.2 of 2017 on
Construction Service. With the regulation, arrangement contained in Civil Code
regarding contractual work agreement, which resembles Construction Contract in
Law No.2 of 2017 on Construction Service, became no longer applicable. The
purpose of this research is to find out how to implementation of the installation
cooperation agreement between PT. Pradana Mulia Raharja and PT. Jeongsuk
Teach Abadi in construction services activities related to Civil Code Jo Law No.2
of 2017 on Construction Services, to find out the obstacles the implementation of
the installations cooperation agreement between PT. Pradana Mulia Raharja and
PT. Jeongsuk Teach Abadi in construction services activities related to Civil Code
Jo Law No.2 of 2017 on Construction Services.
The type of research is empirical juridical research or sociological, which
examines the provisions of applicable law and what happens in reality in society.
This research was conducted at PT. Pradana Mulia Raharja, the population and
sample are PT. Pradana Mulia Raharja and PT. Jeongsuk Teach Abadi. The data
source used, primary data, secondary data and tertiary data collection techniques
in study with interviews and literature study. Whilw the nature of this research is
descriptive qualitative .
The results of this study show that the implementation system of
cooperation agreements of PT. Pradana Mulia Raharja with PT. Jeongsuk Teach
Abadi was done orally then PT. Pradana Mulia Raharja will issue a Work
Warrant or Purchase Order (PO). Because of this, there are obstacles in the
implementation of cooperation in the form of unclear project work time so as to
cause losses for PT. Jeongsuk Teach Abadi. In Indonesia, most of Construction
Dispute didn’t raech court due the condition that all the players in Construction
Industry prefer the confidentiality of arbitration to as dispute resolution.
