ITIKAD BAIK DALAM TRANSAKSI JUAL BELI OBAT TERLARANG (STEROID ANABOLIK) MELALUI MEDIA ONLINE DALAM PRESPEKTIF HUKUM PERDATA

Abstract

The State of Indonesia is a state of law, says Article 1 Paragraph (3) of the
1945 Constitution, that all aspects of life in society, the state and government
must always be based on law. Law in Indonesia is divided into several parts, one
of which is Civil Law. According to Article 1457 the sale and purchase is an
agreement. In online buying and selling activities, there are illegal drugs that are
traded, namely drugs known as anabolic steroids
In collecting data, this research uses normative legal research techniques
using the literature review method. A normative juridical analysis essentially
emphasizes the deductive method as the main guide, and the inductive method as
a supporting work procedure. Then the author draws a deductive conclusion,
namely drawing conclusions from things that are general to things that are
specific. In this writing, the author also uses the method of content analysis.
This study aims to find out the procedures and good faith in buying and
selling illegal drugs such as anabolic steroids online in the perspective of civil
law.
In this study, it was found that there were sellers of illegal drugs such as
anabolic steroids online. The public needs to be aware of the circulation of these
illegal drug products because there is no proven quality and safety, these illegal
drug products are circulated without going through an evaluation of safety,
benefits, and quality by the Food and Drug Supervisory Agency (BPOM). And in
Article 85 of Law Number 3 of 2005 concerning the Sports System, it is also
regulated regarding the prohibition of the use of illegal drugs such as anabolic
steroids because they are included in the category of doping use.
