PELAKSANAAN PERJANJIAN PEMELIHARAAN HEWAN TERNAK SAPI DITINJAU DARI ASAS KEADILAN DI DESA KOTO CENGAR KABUPATEN KUANTAN SINGINGI

Abstract

Agreements in the form of unwritten or oral agreements in general tend to
be considered as weak agreements considering that oral agreements are more
difficult to prove because they are easy to be denied by the promised party when
compared to written agreements with clear clauses, in an agreement for the
maintenance of cattle in general. the community held it in the form of an oral
agreement so that it was not clearly proven what the rights and obligations of
each party were, this study aims to see the implementation of the cattle husbandry
agreement in the Koto Cengar community, Kuantan Singingi Regency from the
principle of justice so that it can be known as long as the agreement provides
justice for the parties.
This study uses the sociological legal method, namely research carried out
directly on the location or in the field to obtain data in order to provide a
complete and clear picture of the problem being studied, in this study a
population of 16 people was determined with a sample of 7 people consisting of
the owner and maintenance community. cows and the Head of Koto Cengar
Village, Kuantan Singingi Regency.
Based on the results of the study, it can be seen that in the implementation
of the agreement for the maintenance of cattle in Koto Cengar Village, Kuantan
Singingi Regency, the parties are bound by a verbal cooperation agreement where
the parties mutually agree on things that they mutually agreed upon in the
negotiations held without making it in written form, This is done by the parties
because they trust each other that neither party intends to harm the other party, in
the cattle maintenance agreement agreed upon by the parties, the parties agree or
agree that the cattle owner has an obligation to provide cattle and bear all losses
arising in the agreement.
