PENEGAKAN HUKUM PIDANA BAGI PELAKU YANG MEMBERI DAN MENERIMA POLITIK UANG PADA PEMILIHAN UMUM ANGGOTA LEGISLATIF DI DESA LEBUH LURUS KECAMATAN INUMAN KABUPATEN KUANTAN SINGINGI
Abstract
This study relates to law enforcement against individuals who give and receive
money politics in the general election for legislative members in Lebuh Lurus Village,
Inuman District, Kuantan Singingi Regency which is regulated in Article 280 Paragraph (1)
letter j and Article 521 of Law Number 7 of 2017 concerning Elections. General. In practice,
there is still money politics in the general elections for members of the legislature. Therefore,
it is necessary to study, first, the enforcement of criminal law against the givers and
recipients of money politics in the general election for legislative members in Lebuh Lurus
Village, secondly, the enforcement of criminal law regarding money politics givers and
recipients in Lebuh Lurus Village from the previous to the present, the three obstacles in
carrying out criminal law enforcement in Lebuh Straight Village.
This research is a sociological legal research, because it is based on field research,
namely by collecting data from observations, interviews, and literature studies that have
something to do with problems that use qualitative data analysis, produce descriptive data,
and conclude with deductive thinking methods.
From the results of the study, it was concluded that, first, the enforcement of
criminal law against the givers and recipients of money politics in the general election for
legislative members in Lebuh Lurus Village was not optimal as expected by Law Noor 7 of
2017 concerning General Elections because it has become a culture in elections. . Second,
the criminal law enforcement of money politics givers and recipients from the past until now
has started well due to the existence of special rules regarding money politics in elections.
The three obstacles in carrying out criminal law enforcement in Lebuh Lurus Village are the
lack of awareness of the community.
