ANALISIS HUKUM TERHADAP PEMBERANTASAN TINDAK PIDANA PERDAGANGAN ORANG (HUMAN TRAFFICKING) DI BATAM. (STUDI KASUS DI WILAYAH HUKUM KEPOLISIAN DAERAH KEPULAUAN RIAU)
Abstract
The development of the era globalisation in rhythm with the development of
crime that occcurs in society. From ordinary crime to extraordinary crime,human
trafficking is one of the illegal businesses that occurs today, either on land and at sea.
Indonesia is an archipelagic country that has many small unguarded borders, which
makes the practice of trafficking in persons very easier to be done, especially in
Batam. This is because the Batam area and its surroundings are archipelagic areas so
that it has quite a lot of official and unofficial port routes and is directly adjacent to
several neighboring countries such as Malaysia and Singapore. So that it becomes a
gateway for human traffickers to enter and exit
This type of research is classified as sociological research, because in this
study the author directly conducts research at the location or place in order to provide
a complete and clear picture of the problem under study. This research was conducted
at Kepulauan Riau Police, Embun Pelangi Fudation, P3AP2KB Service, and while
the population and sample are all parties related to the problem examined in this
study, the source of the data used, primary data, and secondary data, and tertiary data,
the data collection techniques in this study were carried out by interview, and
literature study.
The results of the study include: First, the cause of human trafficking is;
poverty, lack of employment, lack of education and information, and weak law
enforcement and the influence of globalization. Second, the factors of smuggling
activities in an organized manner, the modus operandi is cut off, the budget, the lack
of legal awareness in the community, as well as geographical factors that make it very
difficult to eradicate. Third, The Riau Islands Regional Political Party has made
various efforts to combat human trafficking crimes including; conducting counseling,
seminars, improving social protection programs and collaborating with various
related authorities, which are delivered bhabinkamtibnas, immigration, BP2MI, and
hospitals.
