PENEGAKAN PASAL 259 AYAT (1) PERATURAN DAERAH NOMOR 2 TAHUN 2009 TENTANG LALU LINTAS DAN ANGKUTAN JALAN TERHADAP PERIZINAN PARKIR DI LUAR BADAN JALAN (OFF STREET PARKING) DI KOTA PEKANBARU
Abstract
Article 259 paragraph (1) of Regional Regulation Number 2 of 2009
concerning Traffic and Road Transportation of Pekanbaru City states that "the
construction and operation of off-road parking facilities must obtain a permit from the
local government." in Pekanbaru City, there are still unlicensed parking facilities on the
road, such as Citismart Hotel Jl. Gatot Subroto No. 5, New Holly Hotel Jl. Hang Tua
Ujung No. 108 and KFC Arifin Ahmad. The formulation of the problem in this thesis,
namely: First, enforcement of Article 259 paragraph (1) Enforcement of Regional
Regulation Number 2 of 2009 concerning Road Traffic and Transportation on off-street
parking permits in Pekanbaru City. Second, the inhibiting factor is the enforcement of
Article 259 paragraph (1) Enforcement of Regional Regulation Number 2 of 2009
concerning Road Traffic and Transportation on off-street parking permits. Third, efforts
are being made to overcome the problem of off-street parking that has not been licensed
in Pekanbaru City.
This type of research is a sociological legal research, because it is based on
field research, namely by collecting data from interviews, questionnaires, and literature
studies that are related to the problems to be studied, assisted by primary, secondary and
tertiary data. This research was conducted at the Pekanbaru City Regional House of
Representatives, Pekanbaru City Transportation Service, Pekanbaru City Civil Service
Police Unit, while the population and sample are all parties related to the problem being
studied. This study uses qualitative data analysis and produces descriptive data.
From the results of the study it can be concluded that, First, the enforcement
of Article 259 paragraph (1) of Regional Regulation Number 2 of 2009 concerning Road
Traffic and Transportation in Pekanbaru City has not run optimally. Second, the
inhibiting factors from the enforcement of Article 259 paragraph (1) of Regional
Regulation No. 2 of 2009 concerning Road Traffic and Transportation in Pekanbaru City
are regulatory factors, permit data collection factors, coordination factors between
agencies, and information factors. Third, the efforts made to overcome the inhibiting
factors are making local regulations related to road traffic and transportation and
supervising the implementation of these regional regulations.
