Abstract


The agreement is the most important source that gave birth to the engagement. An agreement is a legal act in which one or more people commit themselves or bind themselves to one or more people. What was realized was an agreement between PT. Padasa Enam Utama as the first party with the Gunung Malelo Village Unit Cooperative (KUD) as the second party engaged in plantations will work on community-owned land for planting oil palm seedlings. This agreement includes a cooperation agreement classified as an anonymous agreement. Every agreement made by the parties aims to meet the achievements, but in this agreement what happens is a default.
The purpose of writing this thesis, namely: first, to find out the implementation of the partnership partnership business partnership, second, to find out the factors causing the default, third, to find out the legal consequences of the achievement of the partnership partnership agreement.
This type is sociological juridical research. This research was conducted at the Tiga Koto Village Unit Cooperative (KUD) located in Sibiruang Village, Koto Kampar Hulu District, Kampar Regency, the data used were primary data, secondary data and data collection techniques in the form of research with interviews, questionnaires and literature studies.
From the results of the study it can be concluded that, first, the implementation of the cooperation agreement between PT. Padasa Enam Utama with Gunung Malelo Village Unit Cooperative (KUD) initially had good intentions since the contract was signed. Over time, there are rights and obligations that are not fulfilled. This agreement, which involves the community, results in a default made by the cooperative to members of the cooperative. As a result of having one of the contents of the agreement that was not fulfilled by the cooperative. Second, the factors causing defaults in this agreement are the misuse of credit funds that are not placed on their individual needs; Income from the sale of members of the cooperative members' palm fruit which is used by the cooperative for personal use; and lack of awareness and understanding of legal regulations and sanctions. Third, the legal consequences of debtors who have defaulted in this cooperation agreement where the debtor is required to pay compensation that has been suffered by the creditor, where the creditor suffered material losses. The achievements made by the debtor have a negative impact on the economic problems of cooperative members.
