PENYELESAIAN TUMPANG TINDIH HAK GUNA USAHA DAN SURAT KETERANGAN GANTI RUGI ANTARA PT. WONOREJO PERDANA DENGAN MASYARAKAT DESA PULUNG REJO KECAMATAN SIMANGAMBAT SUMATERA UTARA

Abstract


Land has a high value seen from any perspective, including glasses of sociology, anthropology, politics, military, and economics. Land is one of the main sources of social power. So valuable is the land that humans who are social beings will defend their land in any way. That was done before culture was formed. That is, it has been like that since the days of early humans. As with animals, there is an instinct for early humans to maintain the territory we now know as "territory". They are aware that the existence of territory is a determination of survival, war is also carried out to secure it. This type of research is sociological law research, because in the research the author immediately conducted research on the location or place under study in order to provide a complete and clear picture of the overlap between PT Wonorejo Perdana and the Pulung Rejo Community, while the population and samples were all related parties with the problems examined in this study, the data sources used, primary data, secondary data, and tertiary data, data collection techniques, in this study with interviews and literature studies. From the results of this study the problem is two main things that can be concluded. First, the causes of the overlapping of HGU and SKGR between PT. Prime Wonorejo with Pulung Rejo Village community. Second Status of land owned by the people of Pulung Rejo Village. Advice from the author, first PT Wonorejo Perdana and Pulung Rejo Community should each show a correspondence about the land problem so that there is no overlapping so that who knows who first had a letter about the land, PT Wonorejo Perdana has SKGU and the Pulung Rejo community has SKGR. Both parties should see accurate evidence in advance so that it is clear and there is no overlapping of the land because there is accurate evidence from each party. Second, the public should increase their SKGR to PPAT so that they have more legal strength that is more certain and stronger. And PT. Wonorejo Perdana, if you don't want the land to be grabbed by the community, then don't abandon the land, manage it so that it doesn't become abandoned land.
