PENYIDIKAN TERHADAP TINDAK PIDANA PEMBAKARAN HUTAN GUNA PEMBUKAAN LAHAN PERKEBUNAN DI TAMAN NASIONAL TESSO NILO OLEH PENYIDIK PEGAWAI NEGERI SIPIL KEHUTANAN BALAI TAMAN NASIONAL TESSO NILO

Abstract

One way people make forests as a place to generate economic benefits is by clearing land to be used
as plantation land. Forest clearing to open plantation land by burning is certainly not justified if it violates
the provisions of the legislation. This is increasingly not justified if the forest burning activities for clearing
the plantations are carried out in the national park conservation forest, which is the function of the national
park which is to manage the native ecosystem, then manage it with a zoning system to ensure the
authenticity of the national park. Tesso Nilo National Park as one of the national parks in Riau Province is
inseparable from the situation. Tesso Nilo National Park has a function to manage national parks and also
has a function to carry out environmental law enforcement in the Tesso Nilo National Park area. One
repressive law enforcement effort when the crime of forest fires has occurred is investigation and
investigation. Tesso Nilo National Park Office has Forestry Police and Forestry PPNS to carry out the
functions of the investigation.
This type of research can be classified as sociological, because in this study the researcher directly
conducts research on the location or place under study in order to provide a complete and clear picture of
the problem under study. This research was conducted at Tesso Nilo National Park and Pelalawan Regional
Police Station, while the population and samples were all parties related to the problems examined in this
study, data sources used primary data, secondary data, and tertiary data, data collection techniques in
research this is by interview, observation and literature study.
From the results of the study, it can be concluded that the Tesso Nilo National Park Office PPNS is
limited in terms of the authority related to conducting investigations into forest burning for land clearing in
Tesso Nilo National Park related to the promulgation of the Republic of Indonesia Minister of Environment
and Forestry Regulation Number: P.7 / Menlhk /Setjen/OTL.0/1/2016 of 2016 concerning the Organization
and Work Procedure of the National Park Technical Implementation Unit then changed to Minister of
Environment and Forestry Regulation Number: P.47 / Menlhk / Setjen / OTL.0 / 5/2016, the lack of forestry
PPNS personnel in the Tesso Nilo National Park Hall, or the lack of budgeting for investigations at the
Tesso Nilo National Park Hall. Then related to the limitations of the investigative authority by the Tesso
Nilo National Park Office PPNS on the acts of forest burning, the investigation was carried out by the
Pelalawan Police Police Investigator, but still with reports and coordination with the Forestry PPNS Tesso
Nilo National Park.
